CoffeeMore Terms of Service
These Terms of Service (the "Terms") set forth the conditions for using CoffeeMore (the "App"). By using the App, you ("User") agree to be bound by these Terms.
Article 1 (Application)
- These Terms apply to all relationships between the User and the operator of the App (the "Operator") concerning the use of the App.
- Any additional rules or notices posted by the Operator within the App form part of these Terms.
Article 2 (Registration)
- Certain features of the App require account registration with an email address and password.
- The Operator may refuse a registration in any of the following cases:
- False information was provided at registration;
- The application is from a person who has previously violated these Terms;
- The Operator otherwise deems the registration inappropriate.
Article 3 (Account Management)
- Users are responsible for managing their account credentials (email address and password) at their own risk.
- The Operator shall not be liable for damages arising from unauthorized use of an account by a third party, except in cases of willful misconduct or gross negligence by the Operator.
Article 4 (User Content)
- Users may post coffee records, photos, comments, and other content (collectively, "User Content") to the App.
- Copyright in User Content remains with the User. However, the User grants the Operator a royalty-free license to use (reproduce, display, distribute, etc.) User Content to the extent necessary to provide, maintain, improve, and promote the App.
- Users warrant that their User Content does not infringe the rights of any third party.
- User Content posted to the timeline and similar features may be visible to other Users.
Article 5 (Prohibited Conduct)
When using the App, Users must not engage in any of the following:
- Acts that violate laws, regulations, or public order and morals;
- Acts related to criminal activity;
- Acts that infringe the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of other Users or third parties;
- Harassment or defamation of other Users;
- Acts that destroy or interfere with the functionality of the App's servers or network;
- Unauthorized access or attempts thereof;
- Using another User's account;
- Directly or indirectly providing benefits to antisocial forces;
- Any other acts the Operator deems inappropriate.
Article 6 (Removal of Content; Suspension of Use)
If a User violates, or is likely to violate, these Terms, the Operator may, without prior notice, remove User Content, restrict the User's use of the App, or delete the User's account. The Operator shall not be liable for any damages incurred by the User as a result.
Article 7 (Suspension of the Service)
- The Operator may suspend or interrupt all or part of the App without prior notice in any of the following cases:
- Performing maintenance or updates of the system;
- Force majeure events such as earthquake, lightning, fire, power outage, or other natural disasters make it difficult to provide the App;
- The Operator otherwise determines that providing the App is difficult.
- The Operator shall not be liable for any damages incurred by the User due to such suspension or interruption.
Article 8 (Account Deletion by the User)
Users may close their account at any time through the procedure provided in the App or by contacting the Operator. Upon account closure, User Content may be deleted in accordance with the method determined by the Operator.
Article 9 (Disclaimer of Warranties; Limitation of Liability)
- The App is provided "as is." The Operator does not warrant that the App is free from defects in fact or in law (including with respect to safety, reliability, accuracy, completeness, or fitness for a particular purpose). The same applies to the accuracy of information obtained through features such as OCR (label scanning).
- The Operator shall not be liable for any damages incurred by the User arising out of the App, except in cases of willful misconduct or gross negligence by the Operator. Where consumer protection laws or other mandatory provisions apply, this limitation applies only to the extent permitted, and the Operator's liability shall be limited to direct and ordinary damages actually incurred.
Article 10 (Changes to or Termination of the Service)
The Operator may change, add to, or discontinue the App upon prior notice to Users.
Article 11 (Amendment of These Terms)
The Operator may amend these Terms when it deems necessary. The amended Terms take effect when posted on this page. In the case of material changes, the Operator will provide notice by appropriate means, such as a notice within the App.
Article 12 (Personal Information)
Personal information obtained through the use of the App will be handled appropriately in accordance with the separately published Privacy Policy.
Article 13 (No Assignment)
Users may not assign or pledge their contractual status or any rights or obligations under these Terms to a third party without the prior written consent of the Operator.
Article 14 (Governing Law; Jurisdiction)
- These Terms shall be governed by the laws of Japan.
- Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Operator.
